Terms of Business CBI
These Terms of Business set out the general terms under which Gullion Limited will provide loss assessing services.
Authorised Status
Gullion Limited t/a Gullion Loss Assessors is regulated by the Central Bank of Ireland as an insurance intermediary registered under the European Communities (insurance Mediation) Regulation, 2005. The Central Bank of Ireland holds registers of regulated firms.

Services Provided
Gullion Limited provides loss assessing services to personal and corporate clients. Gullion Limited does not provide financial advice or any services or advice of any other kind.
Remuneration Policy
Gullion Limited t/a Gullion Loss Assessors is remunerated by a professional fee for work, activity and time spent providing the best terms, advice and service for your specific needs. Our fees are based on 10% of the settlement achieved plus VAT at 23% (if applicable).
We do not charge for our initial consultation and survey.
Gullion Limited may charge an additional service fee, agreed in writing in advance with clients, depending on the complexity of the transaction, time spent and nature and extent of the transaction. Our fees are charged as follows:
- Advisor fees: €175 per hour + VAT
- Support Staff: €125 per hour + VAT
Gullion Limited will furnish invoices for such service fees, in relation to work done, at its discretion in the course of a contract and any sum due on foot of such invoice is payable within 60 days. The client will furnish Gullion Limited with an address for delivery of invoices and any change of address will be valid only if furnished in writing to, and acknowledged in writing by, Gullion Limited.

Conflict of Interests
Our employees are required to comply with the policy of independence and disregard any conflict of interest when making a recommendation to you.
Where an unavoidable conflict of interest arises, we will advise you of the steps we propose to take in order to protect your interests before providing you with any business service. If you have not been advised of any such conflict you are entitled to assume that none arises. Our full conflict of interest procedure is available on request.
Legal rights
Gullion Limited will, if necessary, exercise its legal rights to receive any payment, due from clients, for business services provided, and be reimbursed for any value obtained by the firm on behalf of clients who subsequently default in any payment due to the firm.
Insurers may withdraw benefits, cover, or impose penalties in the event of default of any payments due under any products arranged for your benefit. Details of these provisions will be included in your product terms and conditions.
Complaints Procedure
A complaint is defined as an expression of dissatisfaction by a customer, whether justified or not. Complaints may come from a number of different sources and may be received in writing, by telephone, email, or personal visit.
Our Policy
Our customer complaints are dealt with fairly and all problems are resolved as quickly as possible. All written complaints will be acknowledged in writing within 3 business days. We aim to resolve all complaints within 8 weeks. A copy of our detailed complaints procedure is available on request.
Where customers remain dissatisfied with the outcome of our efforts to resolve their complaint, they are notified of their right to refer their grievance to the Financial Ombudsman Service (FOS).
It is preferred that all complaints are made in writing and should be addressed to Paul Murchan, Director, Gullion Limited at the address set out below.
Confidentiality/Personal Data
We collect your personal details to provide the highest standard of service to you. We take great care with the information provided; taking steps to keep it secure and to ensure it is used only for legitimate purposes. To fulfil these objectives, we may share information with our affiliated professional partners with whom we may have aligned ourselves to from time to time.
The information and other data provided to our company may be used to advise you of product and services we may offer. You have the right at any time to request a copy of any “personal data” within the meaning of the Data Protection Act 2018 (as amended or re-enacted from time to time) that our office holds about you and to have any inaccuracies in the information corrected. All documentation, prepared by or on behalf of Gullion Limited and relating to this agreement, is and remains the property of Gullion Limited.
Gullion Limited also holds Professional Indemnity insurance as required under the FCA regulations.
Gullion Limited has the right to terminate this agreement, at its discretion and by service of notice of termination in writing to the address for delivery of invoice furnished by the client, in the event of any one or more of the following:
Any money payable in arrears for more than (30) days.
- If the client is guilty of any criminal offence relating to the project/premises in which Gullion is involved.
- If the client (being a private individual) dies or becomes of unsound mind.
- If the client (being a private individual) is adjudicated bankrupt or enters into any form of arrangement with creditors.
- If the client (being a company) enters into liquidation (except for the purposes of reconstruction) or into any arrangement with creditors or is subject to any procedure under the Insolvency (Northern Ireland) Order 1989 as amended.
- If the performance of its obligations by Gullion Limited is rendered impossible by virtue of any statutory or other restriction imposed by public authority.
These Terms of Business are valid from 19th March 2021 until further notice. These terms and any documentation referred to above, together with any other document signed by or on behalf of Gullion Limited or acknowledged by email, constitute the entire agreement between Gullion Limited and the client and no oral variation, addition or representation is valid. Any dispute arising from any work carried out by Gullion Limited is subject to the Law of The Republic of Ireland and the exclusive jurisdiction of the Courts in The Republic of Ireland.
Investor Compensation
Gullion Limited is a member of the Investor Compensation Scheme (ICS) established under the Investor Compensation Act 1998. The Investor Compensation Scheme protects clients of an investment firm that goes out of business. The scheme pays compensation when an investment firm authorised by the Central Bank is unable to return money or investment instruments it owes to consumers who invested with it. However, you should also be aware that a right to compensation would only arise where client money or investment instruments held by this Company on your behalf cannot be returned, either for the time being or for the foreseeable future, and where the client falls within the definition of eligible investor as contained in the Act. In the event that a right to compensation is established, the amount payable is the lesser of 90% of the client’s loss, which is recognized as being eligible for compensation, or €20,000.
Gullion Limited also holds Professional Indemnity insurance as required under the Insurance Mediation Directive.
Gullion Limited has the right to terminate this agreement, at its discretion and by service of notice of termination in writing to the address for delivery of invoice furnished by the client, in the event of any one or more of the following:

- If the client is guilty of any criminal offence relating to the project/premises in which Gullion is involved.
- If the client (being a private individual) dies or becomes of unsound mind.

- If the client (being a company) enters into liquidation (except for the purposes of reconstruction) or into any arrangement with creditors or is subject to any procedure under the Bankruptcy Act 1988 (as amended) and the Personal Insolvency Act 2012 (as amended).
If the performance of its obligations by Gullion Limited is rendered impossible by virtue of any statutory or other restriction imposed by public authority.
These Terms of Business are valid from 8th March 2018 until further notice. These terms and any documentation referred to above, together with any other document signed by or on behalf of Gullion Limited or acknowledged by email, constitute the entire agreement between Gullion Limited and the client and no oral variation, addition or representation is valid.
